At Ushay we take the protection of our assets very seriously. To achieve this goal, we focus on the following risk management tools:

Liability Limitation
By structuring each investment project as a stand-alone trust, the investors' risk and liability is limited to their investment. The trust limits responsibility.

Leverage
We don't. Into the trust articles we write restrictions regarding the ability to take on financial debt, requiring special-majorities for decisions to take on debt.

Title to Assets
Title to assets, such as for example land, vehicles, machinery, is held in each individual trust. The trusts are clear in the rights and obligations of all the parties.

Taxes
Fiscal compliance is a permanent consideration. All projects are registered tax subjects, producing annual audited financial statements and tax returns. All investors comply with having an Argentine tax ID which is granted only after identity verification, as required by Argentine law.

We do not provide accounting, legal or tax advice in Argentina nor in any other jurisdiction. Customers are requested to consult their legal, accounting or tax advisor concerning such matters in their jurisdiction of residency and/or in other relevant jurisdictions. Any discussion of any subject that could have legal, tax or accounting consequences contained herein is not intended or written to be used, and cannot be used, in connection with the promotion, marketing or recommendation by anyone for the purpose of avoiding tax-related penalties in any jurisdiction.

Due diligence by our investors
We encourage it, we consider it the backbone of a constructive long-term association that will benefit us all both from the economic and the relationship perspectives.

Know Your Customer and Anti-Money Laundering Compliance
This is core to our business. We require that our investors comply with all the KYC and AML procedures mandated by law, resulting in a safe working environment for us all. Argentina updated its legislation in 2017 and is a member of FATF and GAFILAT.
